This type of insurance includes property and liability auto.

As the owner of a business, you are liable for any products or services you manufacture, sell or offer — and if somebody is hurt as a result of using your product or service, your organization may be at fault for the incident.

When you ask for coverage from our agency, we will determine the likelihood of a lawsuit being brought against you as a result of one of your products or services being used. Our experts can identify the risks associated with your products or services and appropriately scale a policy to cover those risks. We can also offer advice on how to make your products less prone to risk. This may involve modifying your product, packaging it differently, or changing any instructions and warnings included with the product. When done well, these precautions can help reduce the company’s liability and stop customers from using the product in an unsafe way.

Do I need Product Liability Insurance?

If your company manufactures or sells any kind of product, it is strongly recommended that you have some form of liability coverage. Even products that are widely regarded as ‘safe’ can malfunction in a way that causes harm to the user, and defending against a lawsuit is usually expensive enough that many companies (and claimants) prefer to simply settle out of court. Product liability insurance can reimburse you for expenses (including defense costs and settlements) that occurred during this process.

Product liability cases that go to court are among the most expensive forms of personal injury cases, and as of 2013 these cases had an average payout of more than $6 million. All companies that obtain this type of coverage are encouraged to have a policy limit higher than the median payout—anything less makes it likely that your company will suffer significant losses if a jury decides against you.

Don’t forget to talk to your agent on a regular basis as your business continues to grow. Larger businesses often face larger risks than smaller ones (including, among other things, increased exposure as a result of having more customers who could potentially file a lawsuit). A plan that suffices for a small company may not be enough to protect a large one.

What does Product Liability Insurance Cover?

Product liability insurance mainly covers the legal obligations of a company. This may include payments like:

Court fees
Legal defense costs
Personal injury awards
Out-of-court settlements
Miscellaneous fees that may occur during any of the above

These types of plans provide accident medical benefits and, at the sponsor’s option, may include accidental death, dismemberment, dental and disability benefits as well.

Commercial Auto coverage may include liability only or may also provide physical damage coverage. The liability portion covers damage to other vehicles or property and injury to others in accidents for which you are at-fault. Auto physical damage covers repair of vehicles you own.

Your policy covers: Legal liability resulting from injuries to people or damage to their property arising out of the actions of your employees, volunteers, or members.

Your Property Insurance policy can protect your building and its contents — including computers, media equipment, and supplies — from loss or damage from a covered event (typically natural disasters and theft).

This type of coverage (sometimes referred to as Excess Liability Insurance) acts as a “boost” to existing liability policies by offering additional protection (in increments of $1 million) that can be accessed when a claim exceeds those policies’ limits. As you know, your insurance policies cannot offer unlimited protection. If your nonprofit or social services organization encounters a claim that costs more than your policy’s limit, you are responsible for paying the difference.

With Crime Insurance, your policy can include coverage for various situations, such as:

  • Robbery or Burglary
    Computer Fraud
    Employee Dishonesty
    Theft of Business Property
    Forgery

Since there are limitations to your commercial crime policy, you should carefully discuss your options with us to find out what kind of insurance your business needs based on your current situation and potential risks.

Any organization that provides services to youth, developmentally disabled individuals of any age, or senior citizens should consider this type of insurance. The intent of this coverage is to respond to allegations of sexual abuse. This should not be confused with sexual harassment, which is more appropriately insured under a directors and officers policy.

A fidelity bond is a form of insurance protection that covers policyholders for losses that they incur as a result of fraudulent acts by specified individuals. It usually insures a business for losses caused by the dishonest acts of its employees.

Any establishment that sells, serves, or assists in the purchase or use of liquor (i.e. dram shop) opens its doors for a liability claim as a consequence of someone getting drunk to the extent that injuries or property damages are the result. This includes restaurants, bars, nightclubs, and taverns.

Medical malpractice occurs when a hospital, doctor or other health care professional, through a negligent act or omission, causes an injury to a patient. The negligence might be the result of errors in diagnosis, treatment, aftercare or health management.
